Coordinating with the theme of the conference, “Truth is Stranger Than Fiction: Tales of the HR Profession”, employment attorneys Loren Speziale and Zachary Fowler presented “Current Trends and Future Possibilities Under the Fair Standards Labor Act.”From overtime rule changes to employee misclassification, the Fair Labor Standards Act (FLSA) has been and will continue to be in the spotlight. The session delved into current FLSA trends including employee classification, joint employment, wage claims, minimum wage, undocumented worker rights, and more. Discussion included an overview of the law, liability exposures for employers, and the expected level of enforcement under the new administration. Loren and Zach provided attendees with their thoughts on “what to watch for” from the new administration and any new decisions on the horizon.Having presented a similar seminar earlier this year, Loren and Zach found the need to completely overhaul the content after only four months had passed. This significantly reflects the amount of change happening in this area of law. Over 50 of SHRMLV conference-goers attended Loren and Zach’s presentation between the two times it was offered. Many questions were asked, specifically surround paid time for hours worked and employee classification.Loren L. Speziale regularly counsels businesses on corporate and employment matters including business formation, contracts, handbooks and policies, and matters involving personnel policies and claims. She represents private and public corporations as well as privately held businesses. Loren is a member of the City of Bethlehem Human Relations Commission and is well versed in EEOC and PHRC actions.Zachary R. Fowler provides commercial litigation support to businesses in matters concerning employment discrimination and other employment claims as well as contract disputes.
